NEW HAVEN, CT – Eleven lucky immigrants will not face deportation after winning a settlement that involved Immigration and Customs Enforcement agents.
The immigrants had their homes raided on June 6, 2007 and were among 30 people who were arrested by ICE Officials. In an unlikely settlement, the government has agreed to not only give the immigrants a $350,000 check to split up, but will also allow them to remain in the United States.
The immigrants won’t even have to worry about any attorney fees because the lawyers who defended them were working pro bono.
According to Ross Feinstein, the government settled “in order to avoid the additional time and expense of further litigation. ICE recognizes that enforcing our nation’s immigration laws is a weighty responsibility and we endeavor to do so in a judicious and appropriate manner.”
The immigrants in question filed a civil lawsuit in October 2008 in federal court alleging the raids violated constitutional protection against racial profiling. They also claimed ICE officials violated the 10th amendment by targeting New Haven.
The plaintiffs explained in court that the agents held guns to them and pushed open their doors without their consent. They further claimed that the officials did not have warrants to search their homes and they were arrested solely because they were Latinos.
The settlement appears to be the largest ever paid by the government in a lawsuit over immigration raids and the first of its kind to not only issue compensation to the victims, but grant them immunity from deportation.
