Federal Judge Reconsiders South Carolina Immigration Law Following Arizona Ruling

SOUTH CAROLINA – A federal judge in South Carolina has reconsidered his order blocking provisions of the state’s immigration law on Monday after the U.S. Supreme Court upheld similar parts of Arizona’s SB 1070 measure.

On June 25, the Supreme upheld a controversial provision of Arizona’s law that allows local police to check the immigration status of people they stop during routine traffic violations if they believe them to be undocumented aliens.

U.S. District Judge Richard Gergel had blocked a similar provision in South Carolina’s law in December, but following the Supreme Court’s decision, Gergel said he would revisit his previous ruling.

“It appears likely that the court will find it necessary to revise some portion of its preliminary injunction order,” said Gergel.

South Carolina is one of five states, including Alabama, Georgia, Indiana, and Utah, that have enacted anti-illegal immigration laws after Arizona released SB 1070.
